The new Aged Care Act (The Act) and the (Strengthened) Aged Care Quality Standards commence on 1 November. This is the most significant regulatory change in decades. The rights-based framework heightens expectations for governance, accountability, and clinical oversight.

The new legislation now emphasises organisational governance. It requires clear evidence that all systems align with the Act’s principles. Providers need to bring focus particularly to:

  • Board & Executive Accountability: New statutory duties for ‘responsible persons’ require documented due diligence and clear lines of responsibility.
  • Strengthened Clinical Governance: Detailed requirements for continuous improvement in clinical care, medication management, and restrictive practices must be embedded in your operational policies. A robust clinical competency framework must also be in place.
  • Risk Management & Transparency: Robust, organisation-wide risk assessments and sophisticated systems for managing and reporting on all key risks (including critical incidents and consumer feedback) are mandatory.
  • Alignment with the Statement of Rights: Your policies must clearly demonstrate how you uphold the rights and choice of older people.
